Practice Areas
At Licwinko Law, LLC, we provide the following legal services.
Domestic Violence
The New Jersey Prevention of Domestic Violence Act (PDVA) offers protection for anyone over the age of 18 who is experiencing domestic violence (DV) or abuse by a:
- current or former spouse
- current or former household member
- current or former dating partner
- co-parent of a child (including expecting parents)
Criminal offenses covered under PDVA include harassment, assault, terroristic threats, sexual contact, trespass, stalking, lewdness, robbery, restraint, kidnapping, contempt, cyber-harassment, and more. Licwinko Law works confidentially with clients to understand the abuse the client has suffered, identify the strongest legal protection available, and establish a plan to create a safe and stabile future. Victims of DV may also be entitled to employment protection under New Jersey's SAFE Act!
Restraining Orders
Licwinko Law can help domestic violence victims by identifying signs of abuse that qualify for a restraining order, applying for a temporary restraining order, pursuing a final restraining order, obtaining financial support, and making a safety plan to prevent further abuse. Representation also includes seeking protection for children affected by the violence and locating services to assist clients through these alarming times.
Seeking legal representation for matters involving restraining orders often requires finding an attorney in a short amount of time. Licwinko Law prioritizes representation for these urgent matters. And clients' legal fees are often covered under the compensation benefits available to obtain a restraining order through New Jersey's Victims of Crime Compensation Office!
Childhood Sexual Abuse
Caroline has an extensive history of supporting child survivors of sexual abuse and serving as a fierce advocate to navigate the legal hurdles that families experience after disclosure. Caroline is the founder of a national nonprofit organization which supports survivors of child sexual abuse, and from that experience, she effectively represents survivors in a trauma-informed manner.
With the understanding that monetary awards are often one of the last priorities for a survivor, Caroline assists clients with all legal areas that affect survivors, such as custody, access to services, and establishing an individualized education program to support the survivor's needs in school. Caroline also ensures the rights of supporting family members through New Jersey's SAFE Act and Family Leave Act, which provide employment protection for family members caring for sexual abuse survivors.
Education Law
In the area of education law, Caroline advises students, their families, and other members of the educational community on special education issues, IDEA/504 plan matters, constitutional law, due process petitions, administrative hearings, open record laws, and Harassment / Intimidation / Bullying matters. Caroline was recently featured in RealClear Education discussing the risks children face with digitized education. With significant experience in education issues, Caroline zealously represents her clients’ interests, both in and out of court.
Health Law
With a passion for health, Caroline fights for every individual’s right to health. As a legal child advocate, Caroline is featured in the international film, To Dye For: The Documentary, discussing the harmful effects of artificial food dyes on children in America. Caroline will aggressively defend her clients’ right to medical freedom, represent clients in HIPAA matters, and serve as a liaison for children’s health needs in school.
